Quick answer
Establish who has the duty to manage, obtain suitable information about asbestos-containing materials and keep a working register and management plan. Give relevant information before anyone disturbs building fabric. If suspected asbestos is discovered unexpectedly, stop work and obtain competent advice.
Why a tenancy does not settle every asbestos responsibility
HSE’s dutyholder guidance explains that GB responsibility follows maintenance and repair obligations and control. It can rest with an owner, tenant or more than one party. Check the actual agreement and division of responsibilities rather than assuming the landlord handles everything.
Older premises can contain asbestos in building materials and some equipment. Appearance or a casual visual check cannot establish that a material is asbestos-free. An office, restaurant or shop still needs appropriate arrangements when work could disturb affected fabric.
Check whether the survey answers the proposed work
HSE distinguishes management and refurbishment or demolition surveys. A management survey supports normal occupation and routine management. It is not automatic clearance for intrusive work into areas the survey did not inspect.
| Situation | Information to check | Decision before work |
|---|---|---|
| Normal occupation and routine management | Management survey, register, material condition and survey limitations | Maintain the plan and monitor relevant materials |
| New holes, services or alterations | Exact work area and whether hidden materials were investigated | Arrange suitable competent investigation before disturbance |
| Unexpected suspected material | What was disturbed, location and people potentially affected | Stop work, restrict access appropriately and obtain competent advice |
| Shared or leased premises | Maintenance responsibilities and information held by each party | Agree who provides and maintains the necessary information |
Make the register usable before a contractor starts
HSE requires relevant information to reach people who might disturb asbestos. Identify the work area, known or presumed materials, their condition and restrictions. Make survey limitations explicit, including inaccessible areas. Check the contractor has understood the information before the task begins.
For example, a café arranges new cabling above a ceiling. Its register covers visible surfaces but the ceiling void was excluded. The manager does not describe the building as cleared for drilling; suitable investigation of the actual work area is arranged first.
Give the management plan an owner. Schedule appropriate condition checks, record actions and update information following relevant work, damage or new findings. Keep the current version available where maintenance decisions are made.
Keep awareness separate from asbestos-work competence
If suspected material is unexpectedly damaged, stop the task, keep people away as appropriate and contact the responsible manager and competent asbestos specialist. Do not continue drilling, collect a DIY sample or begin cleaning up suspect debris as an ordinary housekeeping job.
An awareness certificate is not authorisation to carry out asbestos work. The work may need particular competence, controls and, depending on its nature, licensing or notification. Use specialists to establish the applicable requirements rather than assuming every job follows one route.
For NI premises use HSENI’s asbestos guidance, including its information on identification, assessment and appropriate work controls. The GB dutyholder source is not a substitute for checking the corresponding NI framework.

Must every asbestos-containing material be removed immediately?
No universal removal rule applies to every material and situation. Obtain competent assessment of its condition, likely disturbance and management options. Leaving a material in place requires suitable management; it is not a reason to ignore it.
Next steps
Before the next maintenance job, confirm the dutyholder, work area and survey limitations. Resolve missing information with competent help before authorising disturbance.
