Draft for review

The full website & account terms

Draft prepared: 12 October 2026
Publication date: [INSERT APPROVED PUBLICATION DATE]
Status: Draft for NFS review. Complete the factual fields and verify the relevant features and linked policies before publication and use.

These terms explain the conditions for using National Food Safety's website, accounts, learning interfaces, resources, business features, verification tools and submission facilities. Paid purchases follow the separate Customer Terms & Conditions identified in clause W.3.

Browsing, watching a free lesson, creating an account, buying assessment access and subscribing to a membership are different activities. An action does not automatically authorise an unrelated purchase, recurring charge or access to private records.

Only features actually supplied apply. Existing accepted agreements, mandatory rights, binding information and enforceable more favourable promises remain protected. The version accepted for an account or feature remains relevant if the public page later changes.

Activity What to know
Free lessons Public lesson videos remain free under their stated conditions. Viewing does not buy an assessment or establish a passing result.
Accounts Use your authorised identity and protect credentials and sessions. A shared device is different from a shared assessment identity.
Business administration Administrators use only their actual authority and reporting access. Paying for a learner does not provide their whole private account.
Resources Follow the actual licence, including permitted workplace use. Your own completed business records do not become NFS property.
Reports and verification A submitted concern is not automatically verified. Certificate verification does not establish a holder's identity or certify a business.
Privacy The privacy notices explain processing and choices. Agreement to these terms is not optional tracking or marketing consent.

W.1. Our identity and contact details

W.1.1 The legal operator of National Food Safety is [INSERT FULL LEGAL NAME AND LEGAL STATUS OF THE OPERATOR], trading as National Food Safety. “NFS”, “we”, “us” and “our” mean that operator.

W.1.2 Our geographical business address is [INSERT VERIFIED GEOGRAPHICAL BUSINESS ADDRESS]. Where applicable, our company number, place of registration and registered office are [INSERT APPLICABLE COMPANY DETAILS]. Our VAT registration number, if registered, is [INSERT VAT NUMBER IF REGISTERED].

W.1.3 Our contact details are:

W.1.4 The correspondence address is not automatically our geographical operating address, registered office, warehouse, visitor or goods-return address. Purchase notice and return destinations follow the Customer Terms & Conditions and Return and Refund Policy.

W.1.5 An account, order, certificate or page reference can help identify an enquiry, but we consider other reasonable identifying information. Do not send passwords, sign-in codes, full payment-card details or unrelated sensitive records through an ordinary support message.

W.2. Scope and the services covered

W.2.1 These terms govern use of nationalfoodsafety.org.uk and associated NFS-controlled accounts, learning interfaces, resources, verification, submission and business features where these terms are supplied. They do not form a second purchase agreement. A third party's separate website or account is not made an NFS service merely because we link to it.

W.2.2 “You” means the person using the relevant service, or the organisation where an authorised person acts on its behalf, according to the activity and contract. A visitor, purchaser, payer, learner, member, recipient and business administrator can be different people with different permissions and rights.

W.2.3 A feature applies only where actually provided. References to account tools, downloads, progress saving, employee reports, public profiles, submissions or automated features do not promise that every feature is available to every visitor or plan.

W.2.4 A person may be a consumer where acting wholly or mainly outside their trade, business, craft or profession. Actual purpose and applicable law determine status; an account label, work email, course topic or employer payment does not alone remove consumer rights.

W.2.5 The website is intended to support legitimate learning, purchases and workplace use within the applicable licence. These terms do not impose a general household-use-only condition or prohibit the business use expressly offered by our products or memberships.

W.3. Purchases, separate notices and document priority

W.3.1 Paid purchases are governed by the NFS Customer Terms & Conditions, where properly supplied and incorporated, rather than by a second purchasing agreement in these Website & Account Terms. The customer document has the following parts:

Part Subject
Part A — Common Purchase Terms Shared buying rules, purchase information, prices, acceptance, payment, supply, cancellation, remedies and purchase disputes.
Part B — Digital Courses and Assessments The actual paid entitlement, learner rules, attempts, results, certificates, access and specific remedies.
Part C — Physical Products Goods, production, delivery, quality, safety, returns and specific remedies.
Part D — Individual Membership The named individual's plan, benefits, billing, renewal, cancellation and continuing rights.
Part E — Business Membership The organisation subscription, covered users/sites, administration, reporting, billing and exit.

Only the parts relevant to the actual purchase apply. The Return and Refund Policy explains the applicable return and remedy routes consistently with that agreement. These Website & Account Terms govern website and account use and do not change an accepted purchase.

W.3.2 Mandatory law takes priority. Lawful specifically agreed service or purchase details, binding descriptions and enforceable more favourable promises remain protected. We read the relevant documents according to their subjects without reducing those protections; purchase-document priority is set out in Part A, clause A.5.

W.3.3 We make relevant account and feature rules available before the affected commitment or use. A blank policy page, document title, unpublished staff instruction or unspecified future terms does not introduce a hidden restriction. A newly added link does not retrospectively replace an accepted agreement.

W.3.4 The Privacy Policy and Cookie Policy explain processing and device technologies. They are not a blanket request to agree to every data use. Any separately required permission, supply request, acknowledgement or statutory notice must have the appropriate basis and presentation.

W.3.5 A changeable help article or summary is not used to remove a binding statement. The absence of a promise from an automated confirmation does not automatically erase its contractual effect.

W.4. Reading the terms and agreeing to an activity

W.4.1 We present the rules relevant to an account or restricted feature at the appropriate stage, with a real opportunity to read and keep them. Important account and access restrictions are brought to attention rather than left only in a footer. Purchase disclosures and choices follow the Customer Terms & Conditions.

W.4.2 Simply visiting a public page or reading this notice is not a positive instruction to buy, subscribe, pay for optional extras, accept detrimental changes to a previous purchase or receive marketing. We rely on the actual lawful agreement and circumstances for the relevant activity.

W.4.3 Where agreement is required to create or use an account or feature, we identify the applicable rules and obtain an appropriate agreement. We do not require a false declaration that every policy has been read and understood. You can ask us about wording before agreeing.

W.4.4 A person acting for an organisation through an account or feature must have actual authority. An authority checkbox is not conclusive proof of that authority or of genuine business status. Using an authorised staff or learner role does not itself make that person personally liable for the organisation's debt.

W.4.5 Account agreement does not itself supply a separately required early-service request, digital-content consent or acknowledgement, or an optional privacy choice. The relevant purchase choices follow Part A, clause A.7; unrelated permissions must not be combined in a way that removes a legally required choice.

W.4.6 If you do not agree to a required account or feature condition, do not activate that feature; contact us about any existing paid entitlement that could be affected. Refusing new wording does not by itself erase an existing contractual remedy, earned certificate or independent privacy right.

W.5. Eligibility, younger users and representatives

W.5.1 The adult-purchaser and purchase-authority requirements are in Part A, clause A.3. Receiving a gift, joining an employer-funded allocation or watching a public lesson does not by itself make the recipient the purchaser.

W.5.2 The adult-purchaser rule does not prohibit younger people from accessing suitable free information or an appropriate course. Particular account, course or interactive features may have relevant eligibility, safeguarding or support requirements, which we identify rather than infer from a general age-of-majority statement.

W.5.3 Where a parent, guardian, employer, school or other representative gives a lawful instruction, its authority depends on the actual relationship and applicable law. A representative does not acquire unrestricted control of a learner's personal records merely by providing a device or paying.

W.5.4 A representative must not impersonate a learner during an assessment or manufacture the learner's agreement. Administrative and approved accessibility assistance are distinguished from prohibited answering or identity substitution.

W.5.5 We consider reasonable adjustments and alternative lawful contact arrangements where someone cannot use the ordinary interface. A need for assistance does not automatically establish incapacity, misconduct or lack of eligibility.

W.6. Accounts, sign-in and credential security

W.6.1 Use your own authorised account or an appropriately delegated administrator account. Do not sell, lend or share an assessment identity or use another person's login without authority. A permitted business seat transfer does not transfer the previous user's identity, result or certificate.

W.6.2 Protect passwords where used, one-time sign-in codes, recovery routes and authenticated sessions. Do not forward a code to someone claiming to be support. Sign out of shared devices and take reasonable steps to protect the email account or other supported sign-in method.

W.6.3 The supported authentication and recovery process is the one actually provided. We may use appropriate verification for recovery or a sensitive change, but we do not promise a particular password, passkey, identity-provider or multi-factor option merely by referring to account security.

W.6.4 Keep information needed for access and important service notices accurate. Tell us about suspected compromise or an incorrect account link promptly. We investigate and use proportionate safeguards rather than treating every action through a compromised account as conclusively authorised by you.

W.6.5 We remain responsible for our own security, access-control and recovery obligations. A reasonable user duty to protect credentials does not remove our responsibility for a failure of the service or make the user automatically liable for every unauthorised charge.

W.6.6 Multiple people may lawfully share a workplace network or device while keeping separate identities and sessions. A shared IP address, changed device, travel, assistive technology or a VPN is not alone proof of fraud or account sharing.

W.7. Account details, corrections and recovery

W.7.1 Provide information you are entitled to supply and identify the correct learner, purchaser and recipient for the relevant purpose. Do not fabricate an identity, qualification, eligibility claim or business authority.

W.7.2 Where a change affects a certificate, paid contract, reporting recipient or payment destination, we may check the necessary authority and supporting information. Checks are limited to what is proportionate and relevant; ordinary naming mistakes are not automatically fraud.

W.7.3 A corrected name, reissued document or recovery request does not create a new achievement or permit transferring an existing result to a different person. The applicable course and certificate correction rules govern the record.

W.7.4 A reused work email or matching name is not sufficient to merge two people's histories or give a new employee the former employee's account. We consider identity and organisational links separately.

W.7.5 You can contact support if the interface cannot complete a legitimate correction or recovery. An inaccessible account does not automatically prevent an effective cancellation, complaint, statutory return or information-rights request.

W.8. Business access, staff roles and sponsored learning

W.8.1 Organisation features are used within the actual Membership Details in Part E — Business Membership or another agreed team arrangement. Covered legal entities, sites, users and permissions must not be expanded simply by changing an account label.

W.8.2 Administrators exercise only their assigned authority. Permission to invite staff, assign learning, edit a profile or view a report is not automatically permission to place purchases, change billing, move refunds, cancel all services or take over a learner's private account.

W.8.3 A payer or employer does not automatically receive personal purchases, another organisation's records, private support messages, disability information or confidential complaints. Organisation reporting follows the disclosed lawful arrangement and appropriate recipient permissions.

W.8.4 Before linking staff, the organisation supplies the relevant worker information and has a valid basis for the enrolment and reporting. A purchase or invitation is not proof of consent to optional tracking or of each employee's acceptance of separate learner rules.

W.8.5 Staff leaving or changing role should lose unnecessary organisation-only access. Historical records, continuing purchased entitlements, personal rights and valid certificates are handled separately under the relevant policies. Offboarding does not permit altering results or transferring a used identity.

W.8.6 A sponsored individual membership remains a personal membership unless a clear team or organisation arrangement was supplied. A gift recipient or employee does not become responsible for the sponsor's subscription simply by using a legitimately allocated benefit.

W.9. Personal information and information rights

W.9.1 Our Privacy Policy explains the personal information handled through our services. The actual processing requires an appropriate lawful basis, transparency and other applicable safeguards; these terms are not consent to every possible use.

W.9.2 We distinguish our independent purposes from processing undertaken on a subscriber's documented instructions. The actual activity determines the parties' data-protection roles. A required processor or joint-controller agreement is not replaced by a generic statement that an employer owns the data.

W.9.3 Users and administrators provide only information appropriate to the feature and their authority. Do not upload unrelated health, financial, identity or employment records merely because an attachment field is available.

W.9.4 Individuals can exercise applicable access, correction, erasure, objection and other rights through the relevant contact route. An employer, payer or administrator does not have a universal veto over an individual's privacy complaint or request.

W.9.5 Retention follows purpose, legal requirements and actual service commitments. Account closure, cancellation and erasure are considered separately. We do not promise immediate deletion of every certificate, transaction, security or open-dispute record, or indefinite retention of every file.

W.9.6 A submission or exported report is not permission for unrelated public disclosure or AI training. Any new processing purpose must have the appropriate lawful basis and disclosure rather than rely on a broad service-use licence.

W.10. Cookies, device choices and communications

W.10.1 Our Cookie Policy explains cookies and similar technologies actually deployed, their purposes and applicable choices. Contract agreement, login or employer funding does not supply optional device consent for every learner or device.

W.10.2 Refusing or withdrawing optional advertising or other consent-dependent tracking does not cancel a paid purchase, membership, assessment entitlement or valid result. Necessary service and security functions are assessed by their actual purpose and applicable rules.

W.10.3 Shared devices and managed browsers can affect saved choices and functionality. A previous user's browser choice is not automatically the current user's personal consent. We provide relevant information and appropriate controls rather than require bypassing workplace security.

W.10.4 Appropriate account, order, invitation, renewal, security and certificate messages are distinct from optional promotional messages. An existing marketing objection is not reset by a new order, staff import, invitation or recovery action.

W.10.5 Clearing browser storage may remove local settings but does not necessarily erase server-held learning or transaction records. Unsubscribing from marketing is not normally subscription cancellation; if a request clearly asks for both, we act on its substance.

W.11. Free lessons, progress and learning records

W.11.1 Public lesson videos are free to watch under their stated access conditions. A free account may be required for a particular saved feature without making the video a paid membership benefit. Any separately paid content is clearly identified before purchase.

W.11.2 Video viewing, saved playback position, module completion, a paid entitlement, an assessment result and certificate status are separate records. Viewing a lesson does not consume a paid assessment attempt or guarantee a certificate.

W.11.3 Progress-saving duration, device dependencies and any account-linking rules are those stated for the actual feature. We do not promise indefinite progress storage or cross-device synchronisation where it is not supplied.

W.11.4 Playback and activity logs reflect events the system captured and can be affected by interruption, inactivity, multiple tabs, connectivity, browser behaviour or assistive technology. They are not conclusive proof of attention, attendance, understanding or practical competence.

W.11.5 Published learning-duration estimates and CPD hours are different from an individual's logged time. Where a time measure is displayed, its actual method and relevant limitations are explained rather than presented as an exact record of everything the person did.

W.11.6 A learner or authorised administrator can raise a missing or inaccurate record concern. We investigate and correct appropriately without fabricating completion or treating a technical discrepancy alone as misconduct.

W.12. Paid assessments and learner conduct

W.12.1 Part B — Digital Courses and Assessments and course-specific information govern the relevant paid entitlement, eligibility, attempts, timing, marking, reviews and awards. These Website & Account Terms do not add a universal pass mark, question count, timer, retake allowance or hidden identity check.

W.12.2 The authorised learner undertakes the assessment honestly and under its published rules. Do not impersonate another learner, answer for someone else, distribute protected answer banks, manipulate records or obtain a document falsely claiming achievement.

W.12.3 Permitted aids, translation, AI tools, open-book resources, assistive technology and proctoring are determined by the actual disclosed assessment and reasonable-adjustment arrangements. A legitimate preparation tool is not automatically authorised to answer an assessment, and approved accessibility assistance is not automatically cheating.

W.12.4 Technical starts, refreshes and resumptions follow the specific attempt rules in Part B. We do not treat every click or failed request as another paid attempt. Supplier failures are considered under the actual entitlement and remedy process.

W.12.5 Integrity concerns use the relevant proportionate evidence and human-review process. A detector, network flag, unusually short logged time or disputed payment is not by itself a final finding. Learners retain the applicable opportunity to respond and appeal.

W.12.6 Employer administration does not confer authority to mark work, change a result, manufacture attendance or remove an award. Learner beneficiary rights and the purchaser's actual cancellation powers remain governed by Part A, clause A.17 and the applicable Part B or Part E provisions.

W.13. Certificates and public verification

W.13.1 An NFS certificate records the named learner's relevant achievement under the particular course and assessment conditions. Payment, membership or access to a template does not by itself establish a qualifying result.

W.13.2 A verification tool checks the relevant NFS record and limited status fields actually supplied. It does not necessarily establish that the person presenting a copy is its genuine holder, or prove current workplace competence beyond the credential's actual scope.

W.13.3 Certificate holders may legitimately download and share their own awards for employment, verification and other appropriate purposes. Users must not alter a holder's name, result, achievement date, scope or expiry, transfer an award to another person or fabricate a verification reference.

W.13.4 Ordinary account closure, membership expiry, staff departure or a payment dispute does not retrospectively invalidate genuine achievement. Actual expiry, correction or justified revocation follows the applicable certificate terms and review process.

W.13.5 An invalid or missing search response can have several causes, including an incorrect reference or technical problem. It is not automatically a final determination of forgery. Contact the certificate support route for an appropriate review.

W.13.6 Public verification is limited to the authorised public information. Do not use it to harvest learner identities, enumerate private records, build an unauthorised personal-data database or expose unrelated account information.

W.13.7 A learner award, member badge, provider registration or directory entry does not itself certify a business, confer an official hygiene rating or show government endorsement. Any recognition claim must accurately identify its substantiated scope.

W.14. Resources, downloads and permitted workplace use

W.14.1 Use guides, templates, checklists, posters, books and other resources within the licence supplied for the item or plan. Public access, a paid download, internal business sharing and permission to resell are different rights. Purchase licences also follow Part A, clause A.18 and the relevant specific part.

W.14.2 Where a resource is offered for workplace use, the permitted reading, printing, adaptation, display or internal distribution is honoured. These terms do not prohibit the intended business use merely because the material is used commercially at a food premises.

W.14.3 Your own completed logs, procedures, business information and original contributions do not become NFS property solely because a resource or platform was used. Rights in an underlying template remain separate from your operational records.

W.14.4 Unless specifically licensed or permitted by law, do not publish a competing copy of a protected resource library, sell digital source files, sublicense restricted content to unrelated clients or remove required notices. Legitimate use of facts, ideas, general knowledge and lawful exceptions remains unaffected.

W.14.5 Post-membership resource use follows the supplied licence. A continuing licence expressly granted is honoured; subscription-only updates and newly published materials are not automatically included forever. Lawfully created business records and valid training evidence are treated separately from continued software access.

W.14.6 Ownership and lawful resale of genuine physical goods differ from the right to reproduce protected text, artwork or digital files. A product purchase or membership does not automatically authorise acting as an NFS-approved trainer, inspector or reseller.

W.15. Tools, calculators, simulations and safety guidance

W.15.1 A tool or calculator is used for its stated purpose and with the relevant units, inputs, jurisdiction, date and assumptions. Where an output is an estimate, illustration or training scenario, we identify that limitation rather than present it as a verified measurement of a real premises.

W.15.2 Check that an output is suitable for the actual task before applying it to an operational or safety decision. An illustration does not establish that a food process is safe, a record was completed or a legal requirement was met.

W.15.3 General guides and training support practical decisions within their stated scope. They do not automatically provide a bespoke legal opinion, inspection, professional consultancy or determination by a regulator. A specific advisory or suitability promise we accepted remains binding.

W.15.4 We remain responsible for accurate descriptions, appropriate care and skill, relevant supply standards and obligations we actually agreed. A request to check inputs is not a universal disclaimer for unsafe instructions, defective tools or materially incorrect supplied content.

W.15.5 A business remains responsible for its actual operations, risk assessments, staff supervision and truthful records. Do not use generated examples or filled templates as evidence that a check, inspection, measurement or training event actually occurred.

W.15.6 If a feature uses AI-generated assistance, its actual function, material limitations and information handling must be disclosed for that feature. These terms do not promise that an AI assistant is available, universally accurate, qualified as a professional or entitled to use confidential submissions for unrelated training.

W.15.7 Report an apparent unsafe instruction or material calculation error through support, identifying the resource and concern. For an immediate risk, take appropriate protective action and contact the relevant emergency service or authority rather than wait for a website response.

W.16. Availability, compatibility and accessibility

W.16.1 We take appropriate care in operating the services and respect any binding delivery, support or availability promise. We do not invent a guaranteed uptime percentage, instant response or permanent access period that was not offered.

W.16.2 Technical compatibility, supported environments and material restrictions depend on the actual feature. Material paid-service requirements follow Part A, clause A.27. Users should use suitable devices and supported software, but their environment does not automatically excuse our own service failure.

W.16.3 We may carry out proportionate maintenance, improvements and necessary security work. We give relevant notice where practicable and consider the impact on purchased access, active assessments and contractual remedies.

W.16.4 An interruption, retired feature or external service fault is handled according to the affected commitment and applicable law. We do not treat a paid benefit as supplied merely because the calendar period passed while our promised access was unavailable.

W.16.5 We consider accessibility and reasonable-adjustment requests appropriately, including requests made after purchase. Approved assistance and lawful accessibility tools are not prohibited by a general automation restriction. Health or support information is not automatically shared with an employer or payer.

W.16.6 An adjustment we are legally required to provide is not subject to an extra charge. Contact us if an inaccessible interface prevents use, cancellation, correction or a complaint so an appropriate lawful route can be considered.

W.17. External services and the relationship with Shopify

W.17.1 Our store uses Shopify technology. Purchases from the NFS store are made with the NFS legal operator identified in clause W.1, unless a particular transaction clearly identifies another seller. Shopify's role as platform provider does not make it the merchant for an ordinary NFS purchase.

W.17.2 Separate providers may supply authentication, payments, embedded video, hosting, communications or other functions. Their own terms or privacy information may apply to a separate relationship or feature, and we identify material conditions where appropriate.

W.17.3 We remain responsible for obligations we undertake to deliver through an integration or subcontractor and for our own decisions about deploying it. A third party's involvement is not a universal exemption from NFS responsibility.

W.17.4 External links can lead to independently operated content and services. We distinguish that independent destination from a benefit we have contracted to supply. A link does not necessarily endorse its content, and concerns about it can be reported to us where they relate to our own publication or service.

W.17.5 We do not require a general release of every possible claim against Shopify or another provider merely because the site uses their technology. The actual relationships, separate agreements and mandatory legal rights determine responsibility.

W.17.6 A provider's privacy practices, cookies or account choices are explained through the appropriate notices. An embedded player described as privacy-enhanced does not by itself guarantee anonymity or eliminate our duties over technologies we deploy.

W.18. Intellectual property, branding and lawful exceptions

W.18.1 NFS or the relevant rights holder retains rights in protected website text, course media, assessment banks, software, artwork, templates, certificate designs and branding. The licence supplied for the actual resource or feature determines permitted use.

W.18.2 Those rights do not mean we own public facts, ideas, general knowledge, official records, your business information, your completed operational records or independently created material. Other organisations' content and marks remain subject to their relevant rights.

W.18.3 Do not falsely imply affiliation, provider approval, government endorsement or authority to act for NFS. A paid membership or learner award is not a general licence to use every NFS or third-party recognition mark for any purpose.

W.18.4 Legitimate certificate sharing, appropriately licensed workplace printing, adaptation and internal distribution remain permitted. Required attribution or licence conditions supplied for the resource continue to apply.

W.18.5 Nothing here removes an applicable statutory copyright exception, lawful access right or lawful resale right. We do not describe every quotation, accessibility use, security concern, automated tool or reuse of an official fact as infringement merely because it involves website material.

W.18.6 Send an infringement concern through support with the material's location, your relevant rights and a clear description of the issue. We consider appropriate removal, correction and response routes without treating an unsupported claim as conclusive ownership evidence.

W.19. Submissions, ownership and limited use permission

W.19.1 Submissions can include support messages, uploaded certificate evidence, business information, reviews, profile content, reports, artwork and feature feedback. Their purpose and visibility differ. A private support or security report is not automatically public review content.

W.19.2 You retain rights in your original contributions and give us only the permission needed for the requested feature, appropriate support, security and lawful records. For content knowingly supplied for publication, this includes the relevant hosting, display, distribution and proportionate formatting or redaction necessary for that publication.

W.19.3 You must have the necessary rights or lawful authority to submit material and disclose other people's information. Provide accurate material to the best of your knowledge, distinguish fact from opinion, and correct a material error when you become aware of it. A good-faith mistake is considered on its actual circumstances rather than automatically treated as deliberate fraud.

W.19.4 Do not submit malware, unlawful threats, targeted harassment, discriminatory abuse, unlawful defamatory allegations, protected assessment answers or unrelated private data. Redact unnecessary identifiers and sensitive details while keeping evidence relevant to the concern. Tell us if a private document needs particularly careful handling.

W.19.5 This permission does not grant us a perpetual right to use every confidential complaint, staff photograph, logo or private record in unrelated advertising or AI training. A testimonial, case study, promotional image or other additional use requires the appropriate separate agreement and lawful basis.

W.19.6 We may use necessary service providers within appropriate contractual and privacy arrangements. That is not permission to sell confidential submissions, abandon our security duties or disregard the restrictions of a third-party source you identified.

W.19.7 Relevant publication permissions last for their agreed lawful purpose and retention, with appropriate treatment of removal requests, archived records and legitimate evidence. We do not promise immediate erasure of legally retained material or claim permanent unrestricted exploitation of every submission.

W.19.8 Optional suggestions do not create an automatic fee entitlement unless agreed. They also do not require the contributor to disclose confidential inventions or waive every intellectual-property right merely to ask for support. Any separate development, payment or publicity arrangement needs an actual agreement.

W.20. Business profiles, official information and public concerns

W.20.1 A business profile or directory claim is available only through the actual feature and verification process. A matching name, address, payment or membership does not conclusively establish authority over a listing.

W.20.2 Authorised profile users can provide accurate business information within their actual permissions. They must not publish a learner's private account, personal contact information, medical details or another person's confidential records without the appropriate lawful basis.

W.20.3 Official food-hygiene ratings and related public records remain attributed to the issuing body. We distinguish their source and update date from business-supplied text and user concerns. A data match can be incomplete or wrong and can be challenged through an appropriate correction route.

W.20.4 Claiming a profile or purchasing membership does not authorise changing an official rating, publishing an unverified source as verified, implying an inspection occurred or describing NFS as the issuing regulator. Membership, a directory presence and an official rating are separate matters.

W.20.5 A report about a business or certificate should identify the relevant subject, facts known directly, supporting information and the nature of the concern. An allegation is not automatically an established finding, and a website submission does not itself mean a regulator, police force or certificate issuer has investigated it.

W.20.6 A private report is received for the disclosed review purpose. It is not automatically published. If a feature permits public submissions, its visibility, relevant personal-data handling and publication rules are explained before submission, and content follows the appropriate lawful moderation process.

W.20.7 Reporter names, email addresses and private evidence are not automatically displayed on a public business profile. Relevant lawful disclosure to an affected person or authority is assessed according to the purpose, process and applicable rights, rather than promised as absolute anonymity or unrestricted publicity.

W.20.8 Membership or a payment does not buy suppression of legitimate official information or honest lawful criticism. A business can dispute incorrect content, impersonation or an inaccurate match without acquiring the right to alter evidence or obtain another person's full private records.

W.20.9 A reporting form is not an emergency response service. If a situation poses an immediate danger, contact the appropriate emergency service or authority and take suitable protective action. Submission to NFS does not by itself fulfil every duty to report a concern elsewhere.

W.21. Reviews, community content and moderation

W.21.1 Interactive reviews, comments, public responses or community features apply only where actually provided. Their rules identify permitted content, visibility and the relevant report or review route. These terms do not promise a social network, instant publication or a fixed response time that has not been offered.

W.21.2 Reviews should concern an authentic experience and distinguish opinion from factual allegations. Do not create fake reviews, conceal an applicable incentive, impersonate another person or coordinate misleading positive or negative submissions.

W.21.3 Lawful disagreement, honest criticism, a genuine complaint or a protected report is not prohibited merely because it reflects negatively on NFS or a member business. We do not require users to keep every complaint secret or prohibit lawful contact with authorities.

W.21.4 We assess moderation according to content, evidence, privacy, safety, rights and applicable law. Appropriate action can include seeking clarification, redaction, a warning, correcting a match, temporarily withholding publication or removing unlawful material. We do not treat our initial decision as beyond review.

W.21.5 Where appropriate and lawful, we explain a relevant restriction and offer the affected person a meaningful way to challenge it. Information may be limited where needed to protect another person, an investigation or security, without removing an applicable legal notice or complaint duty.

W.21.6 Report apparently unlawful, harmful, infringing or inaccurate published material through support, identifying its URL or reference, the specific concern and an appropriate contact route. We consider the actual notice and use any legally required procedure; a preferred form is not a universal precondition to making a valid complaint.

W.21.7 A user promise of accuracy or a label that content represents someone else's view does not remove NFS's own applicable publication, safety or response duties. We do not claim blanket immunity from defamation, privacy or other liability merely because content originated with a user.

W.21.8 Public-content functions are operated in accordance with the legal requirements applicable to their actual design and audience. These terms do not declare all NFS features exempt from online-safety law or establish compliance merely by describing moderation.

W.22. Acceptable use and prohibited misuse

W.22.1 Use the service for lawful purposes and within the actual rights supplied. Do not knowingly use it to impersonate people, commit fraud, interfere with someone else's access, threaten violence, engage in targeted harassment or infringe another person's lawful rights.

W.22.2 Do not obtain or attempt access to accounts, learner records, organisation data, restricted files or administrative functions without authority. An exposed address, identifier or technical endpoint does not itself authorise access to another person's information.

W.22.3 Do not fabricate certificates, results, inspections, eligibility evidence or operational records; manipulate entitlements, allowances or assessment events; or bypass a disclosed access-control measure to obtain an unpaid benefit.

W.22.4 Do not introduce malicious code, credential theft, phishing, destructive requests, denial-of-service activity or other deliberate disruption. Do not repeatedly evade a legitimate targeted restriction by creating replacement identities or using someone else's account.

W.22.5 Do not use private information obtained from a feature for unauthorised tracking, data harvesting, marketing or publication. An allowed export or verification response does not remove privacy duties or expand its agreed purpose.

W.22.6 Honest complaints, lawful criticism, protected disclosures, reasonable accessibility use and properly authorised business functions remain permitted. A conduct rule is not used as a general ban on anything inconvenient to NFS.

W.22.7 Proportionate technical controls may protect the service, but an automated flag does not alone establish breach. We distinguish legitimate retries, assistive tools and shared networks from deliberate abusive activity.

W.23. Automation, integrations and AI-assisted use

W.23.1 Use a supplied API, export, integration or automation facility within its published scope, applicable licence and authority. We identify relevant limits and conditions for the actual facility; these terms do not create an undisclosed open API or unlimited bulk access.

W.23.2 Authorised search indexing, accessibility software, ordinary browser functionality and integrations we actually permit are not treated as prohibited solely because they use automation. Access to restricted personal records, protected assessment banks or administration functions still requires the appropriate authority.

W.23.3 An automated tool must not evade access restrictions, impersonate an authorised user, disguise malicious requests or place purchases without the principal's valid authority. Any compulsory identification or rate-limit requirement must be stated for the relevant supported service rather than assumed from a hidden instruction.

W.23.4 Do not use automation to reproduce a restricted resource service, extract protected answers, harvest private records or overload the platform. Statutory exceptions and rights are considered on their actual facts; technical availability is not permission for every use.

W.23.5 AI-assisted preparation and an automated assessment answer are different activities. Actual assessment rules determine permitted aids. We do not impose a blanket ban that wrongly excludes legally required assistive use or promise that AI-generated output is always correct.

W.23.6 A tool's user remains responsible for instructions and transactions actually attributable to them under the relevant law and agreement. These terms do not make someone conclusively liable for every unapproved action through a compromised or malfunctioning third-party tool.

W.24. Reporting a security vulnerability

W.24.1 Report a suspected NFS security issue confidentially to cs@nationalfoodsafety.org.uk or the contact route, clearly identifying it as a security concern. Provide a minimal description, affected location and non-sensitive evidence sufficient to help us investigate.

W.24.2 Discovering or reporting a possible vulnerability does not itself authorise further testing, access to another person's data, destructive scans, denial of service or tests against Shopify or another independent provider. Authorised testing requires a separately defined scope and permission from the appropriate system owner.

W.24.3 Do not extract or publish private learner or payment information as proof. If accidental access occurs, stop the affected activity and contact us with the minimum necessary information. We assess the incident and relevant duties rather than require collecting more people's data.

W.24.4 We consider a good-faith report appropriately and avoid treating the act of reporting alone as misconduct. This is not a promise of a financial reward, a vulnerability bounty, blanket criminal immunity or legal authorisation for an activity outside agreed scope.

W.24.5 Reasonable arrangements for coordinated disclosure protect users and allow investigation without requiring unlawful secrecy or preventing a legally protected report to an authority. Any separate disclosure or testing agreement must respect applicable law.

W.25. Investigations, restrictions and review

W.25.1 We can make proportionate checks and temporarily restrict an affected function where reasonably necessary to address a credible security, payment-authority, integrity, unlawful-content or misuse issue. The action has a legitimate basis and scope rather than a universal right to block anyone at any time.

W.25.2 Where lawful and practicable, we explain the relevant issue and a route to resolve or challenge it. We may protect confidential information or sensitive security details while still providing meaningful review and any legally required notice.

W.25.3 Restrictions are directed at affected functions, content, accounts or entitlements. They do not automatically cancel every purchase, block every employee, erase evidence or invalidate all legitimately earned certificates.

W.25.4 A pending flag is not a final finding of fraud or cheating. Assessment findings follow Part B; public-content concerns follow their applicable review process. We consider context, potential errors and the user's response.

W.25.5 Support abuse or repeated inappropriate contact may require a proportionate communications arrangement. We preserve an effective route for cancellation, a statutory notice, privacy rights, refunds and lawful complaints rather than demand that every legal communication use an inaccessible account.

W.25.6 If a concern is not supported, we restore or correct the affected position appropriately. We consider lost usable paid access and other applicable remedies; an investigation is not a licence for indefinite paid non-supply.

W.26. Account closure and continuing rights

W.26.1 You may stop ordinary website use and request account closure through the supplied account or support route. If a paid agreement is involved, we explain the relevant cancellation and financial position and act on any clear cancellation instruction contained in the request.

W.26.2 We may end access for a sufficiently serious substantiated breach or another valid legal or contractual reason. Where appropriate, we give notice and a reasonable opportunity to put matters right. An urgent risk may require immediate targeted action, followed by an appropriate review route.

W.26.3 We do not close an account merely to retaliate against a genuine refund request, honest review, complaint or exercise of rights. A lawful restriction does not automatically permit keeping all prepaid money or adding arbitrary penalties.

W.26.4 Commercial discontinuance of a feature respects applicable notice, delivery, alternative-supply and refund rights. A generic website clause does not remove a promised assessment window, membership period, goods claim or continuing resource licence.

W.26.5 Valid certificates, historical achievements and personal rights remain governed by their relevant agreements and law. Account closure does not automatically erase every necessary retained record or oblige you to keep paying to preserve genuine achievement.

W.26.6 We provide an appropriate route to obtain purchase records, personal information and certificates you remain entitled to receive where ordinary account access ends. Actual retention, export and post-closure facilities are explained through the relevant policy or offer, rather than promised indefinitely.

W.26.7 Legitimate intellectual-property, confidentiality, data-protection, payment and dispute obligations can survive where their nature, agreement and law require. Survival wording does not create a new subscription charge or revive an obligation already extinguished by a lawful cancellation.

W.27. Changes, versions and service development

W.27.1 We may update these terms for future use to reflect actual services, a legal requirement, proportionate security measures or another legitimate change. We identify the version and publication date and bring significant relevant changes to attention.

W.27.2 The accepted version, binding purchase information and actual contract remain relevant to an existing entitlement. Publishing a replacement page or recording continued use of a paid period is not automatic acceptance of an undisclosed detrimental change.

W.27.3 Material changes to an existing paid purchase follow Part A, clause A.25 and the applicable specific part. These Website & Account Terms do not change the accepted purchase or remove its membership notice, choice or remedy protections.

W.27.4 For a significant change to ongoing free-account rules, we provide reasonable notice and an appropriate choice where practicable. A person may stop using the affected free feature without losing an independent paid remedy, certificate or information right.

W.27.5 Necessary legal or urgent security changes may require shorter notice where lawful and reasonable. We explain them as soon as practicable, limit their effect appropriately and preserve relevant remedies. They do not automatically justify an unrelated price increase or destruction of accurate records.

W.27.6 New features have their actual stated scope and any relevant additional terms before use. A prototype, example or aspirational feature description is distinguished from a current entitlement, without undermining a firm promise we have actually made.

W.28. Liability and protected rights

W.28.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, non-excludable product liability, or any right or liability the law does not permit to be excluded or limited.

W.28.2 For consumers, we remain responsible for loss or damage arising from our breach or failure to use appropriate care where the relevant legal rules make it recoverable, including reasonably foreseeable loss where applicable. A course fee, free-account status or membership payment is not a universal cap on every valid claim.

W.28.3 We remain responsible for our own website and platform obligations. Describing material as general information, using Shopify or another provider, or asking you to check a result does not excuse those obligations. Mandatory purchase standards, binding descriptions and suitability promises also remain protected under Part A, clauses A.22 and A.31.

W.28.4 Genuine business loss and any specifically agreed risk allocation are assessed under the actual contract and law, including applicable reasonableness requirements. These terms do not introduce an arbitrary fee cap or universal exclusion of every business loss; any separately proposed limitation must be properly incorporated and lawful.

W.28.5 Users remain responsible for their actual misuse and obligations, and businesses retain their operational and regulatory duties. A claim arising from that conduct requires its actual lawful basis. We do not demand reimbursement of every third-party claim, fine, legal bill or loss irrespective of fault and causation.

W.28.6 Both parties take reasonable steps to reduce a loss where legally required. This does not require following unsafe instructions, accepting an inadequate remedy or destroying evidence. A support deadline or reporting request does not shorten an applicable statutory claim period.

W.28.7 These terms do not release independent providers from every possible claim or prevent a person using a legally available court, payment-provider, consumer-protection or regulatory route. Responsibility is determined by the actual law and relationships.

W.29. Complaints, content notices and contact routes

W.29.1 Raise an account, learning-interface, certificate-verification, privacy or published-content concern through the contacts in clause W.1. Provide the relevant reference and desired outcome where possible. A learner may raise an independent issue even if a sponsor or employer paid.

W.29.2 We consider a complaint and explain the appropriate next step or review route. Course appeals, purchase remedies, membership cancellation and privacy requests retain their relevant substantive rules. Purchase complaints follow Part A, clause A.32; ordinary platform support wording does not replace those rights.

W.29.3 A content complaint should identify the location, the specific statement or material, the claimed inaccuracy or right affected and a contact route where reasonably required. We act according to the applicable legal process and evidence, not a blanket promise to remove every critical statement on demand.

W.29.4 We protect private evidence and consider justified confidentiality requests, but do not promise absolute anonymity or secrecy where lawful disclosure is required. A customer does not have to keep a legitimate complaint confidential to preserve a refund or other mandatory remedy.

W.29.5 We provide legally required information about a relevant independent dispute-resolution route at the applicable stage. We do not claim membership of an unverified ADR scheme or force a consumer into a compulsory private arbitration arrangement that removes protected court access.

W.29.6 A support discussion does not automatically stop a statutory claim or appeal deadline. You can approach an authority with jurisdiction or take other legally available action. We encourage practical resolution without making it an unlawful prerequisite to every claim.

W.30. Notices, transfers and general provisions

W.30.1 Material account notices use the relevant agreed contact route and any required retainable format. Keep important contact details current. A legally effective notice is not invalid merely because another valid route was used instead of our preferred form. Purchase notices follow Part A, clause A.33.

W.30.2 We may transfer our website or account responsibilities only lawfully and while respecting protected rights, accepted service commitments and data-protection responsibilities. A change of provider or operator does not make existing records, awards or remedies disappear. Required notices and permissions are observed; purchase transfers remain governed by Part A.

W.30.3 A user or organisation transfer follows the actual service and licence conditions. A valid administrative transfer or unused seat reassignment does not mean a completed learner identity or certificate can be reassigned.

W.30.4 If a provision is unenforceable, the remainder continues so far as lawful and workable. This does not allow an unfair term to be rewritten retrospectively to a consumer's disadvantage. A delay in enforcement does not automatically waive every future right.

W.30.5 We do not exclude an enforceable account or service promise, binding description or legal remedy through an entire-agreement label. Ambiguous consumer terms retain the interpretation protections the law gives them. Purchase promises remain governed by the Customer Terms & Conditions.

W.30.6 Participation alone creates no agency, partnership, employment or authority to bind NFS. A separate actual relationship must be specifically established. An account, membership or provider registration is not a regulatory office or licence.

W.30.7 Express learner beneficiary rights, the relevant Customer Terms & Conditions provisions and mandatory third-party rights are preserved. These Website & Account Terms do not substitute a blanket exclusion for the intended learner rights in an employer-funded assessment agreement.

W.31. Governing law and courts

W.31.1 These terms are governed by the law of England and Wales except where a mandatory rule requires otherwise. The choice does not remove mandatory consumer protection preserved for a person's habitual residence.

W.31.2 Consumers may use the courts available under applicable jurisdiction rules, including an appropriate local court where permitted. These terms do not require a Scottish, Northern Irish or overseas consumer to surrender a protected local court right.

W.31.3 For a genuine business agreement, exclusive England and Wales jurisdiction applies only where lawfully agreed for that agreement, subject to any specifically agreed lawful alternative and mandatory jurisdiction rules. Merely having an organisation account does not conclusively establish agreement to a purchase jurisdiction clause; purchase arrangements follow Part A, clause A.34.

W.31.4 These terms do not prevent a lawful complaint to a regulator, local authority or other body with jurisdiction, or replace a mandatory statutory route. No reference to an overseas platform imports a foreign consumer jurisdiction clause into an ordinary NFS purchase.
